New e-discovery rule changes go into effect; Corporations ill-prepared, large fines looming

          information. Now more than ever, corporations are faced with being
          litigation-ready for electronic discovery well before any action
          is filed.

          As reported in InsideCounsel (May 2006), the results of a 2005
          study reflected that a mere 14 percent of the legal departments
          surveyed felt they can handle e-discovery requests, with only
          28 percent rating their companies as proactive with respect to
          litigation readiness. In addition, a recent survey conducted by
          Computerworld magazine found that 42 percent of 170 IT
          professionals surveyed are uncertain of the status of their
          company's preparation for the rule changes. Thirty-two percent
          said that their company is not prepared at all.

          With the rule changes shifting the burden to the responding party
          for addressing electronically stored information, limiting the
          time to complete discovery and provide guidance to the courts
          regarding sanctions, corporations that remain reactive, or rely
          solely on IT departments for e-discovery, are at a greater risk
          for fines.
